High Court Blocks Delhi Gang Rape Convicts Plea Slaps 25000 Fine on Lawyer

First, let me tell you that a 23-year-old paramedic student was gang-raped and brutally assaulted in South Delhi by six men and was thrown on the road, the girl died at a hospital in Singapore while getting treated. She died on December 29, 2012.

Last Thursday Pawan Kumar Gupta’s claim was rejected by the court, he is the convict in the gang rape December 16. His lawyer was trying to make him out of the case by saying that he was a juvenile at the time of the crime but the court said that at this stage age can not be determined. Also, when Justice Suresh Kait was rejecting the plea, slapped a fine of ₹25,000 on AP Singh who requested this and wasted the time of the court, AP Singh was trying to use delaying tactics. Suresh Kait asked Bar Council of Delhi to file an affidavit against AP Singh pertaining to the age.

On the same day, in the morning the court passed an order of adjournment due to the case related to the plea filed by the convict that he was a juvenile when the incident happens in the late in 2012. Again AP Singh used another trick on the next day when the matter just going to come up to Justice Suresh Kait, AP Singh requested a sought of time from the court that he will present some additional witness in another hearing.

Later State counsel, as well as advocate, appearing for the case mentioned by the parents of the 23-year-old paramedic student. When both came to the court they stated that these are the tactics used by them to drag the matter and also said that the accused has already been rejected by the Supreme court. The trial court has also fixed January 7 as the next hearing in the last plea assured issuance of the death warrant.

The Court asked for an ossification test to detect convicts age to settle this juvenility issue but Gupta’s lawyer Mr. Singh stated that the ossification test will not be conducted by investigating officers. Singh also pronounced that Gupta is an innocent boy and was trapped falsely in this case.
